This Declaration of Covenants, Conditions and Restrictions for Marbrey
Landing Subdivision made and entered into the fifth day of September, 1996 by
MARBREY LANDING, L.L.C., a North Carolina Limited Liability Company, 1801 Martin
Luther King Parkway, Suite 120, Durham, North Carolina 27707 (hereinafter
referred to as "Declarant").
WITNESSETH:
WHEREAS, Declarant is the owner of certain Properties located in the County of Durham, State of North Carolina, and
WHEREAS, Declarant desires to subject the Properties to certain protective covenants, conditions, restrictions and easements as hereinafter set forth, and
NOW, THEREFORE, Declarant hereby declares that all of the Properties described hereinafter shall be held, sold and conveyed as part of its general plan of development subject to the following easements, restrictions, covenants and conditions, which are for the purpose of enhancing and protecting the value and desirability of, and which shall run with, the Properties and be binding on all parties having any right, title or interest in the described properties or any part thereof, their heirs, successors, and assigns, and shall ensure to the benefit of each Owner thereof.
ARTICLE I
DEFINITIONS
Section1. "Owner" shall mean and refer to the record owner, whether one or more persons or entities, of a fee simple title to any Lot which is a part of the Properties, including
